Supreme Court Advocate Tom Jacobs '90--Moot Court Argument on Sept. 19 at the Rogers College of Law

Before Tom Jacobs '90 argues Arizona v. Gant in the U.S. Supreme Court on October 7, he will argue here at the Rogers College of Law.  The argument will be on Friday, Sept. 19, in the Appellate Courtroom, beginning at 12:15.   Gant is the most important automobile search and seizure cases in years.  Here's the question presented:

THE PETITION FOR A WRIT OF CERTIORARI IS GRANTED LIMITED TO THE FOLLOWING QUESTION: DOES THE FOURTH AMENDMENT REQUIRE LAW ENFORCEMENT OFFICERS TO DEMONSTRATE A THREAT TO THEIR SAFETY OR A NEED TO PRESERVE EVIDENCE RELATED TO THE CRIME OF ARREST IN ORDER TO JUSTIFY A WARRANTLESS VEHICULAR SEARCH INCIDENT TO ARREST CONDUCTED AFTER THE VEHICLE'S RECENT OCCUPANTS HAVE BEEN ARRESTED AND SECURED?

Here's the 3-2 Arizona Supreme Court decision.  And here are some of the briefs:  Arizona's Brief Gant's Brief  Arizona's Reply Brief Amicus Brief, National Association of Federal Defenders  Amicus Brief of the United States  Thornton Oral Argument Transcript
