Professor Mackay. The Insanity Defense – Arizona, English Law and the Legacy of the M’Maghten Rules

Please join PCLP and LEADS in welcoming Professor Ronnie Mackay from the Leicester De Montfort Law School in Leicester England. Professor Mackay is a Professor of Criminal Law and Mental Health. His presentation will contrast the law relating to the defense of insanity in Arizona and England. The former has altered its insanity defense on several occasions post-Hickley while the latter continues to apply the M’Naghten Rules as laid down in 1843. What can we learn from the operation of the insanity defense in these different jurisdictions, both of which continue to adhere to an approach which many consider anachronistic and much in need of reform? Here is a link to the Leicester de Montfort Law School website where you can access a relevant article written by Professor Mackay:

Please join PCLP, Justice Advocates Coalition (JAC), and the American Constitution Society (ACS) in hosting Andrea Fenster and Tiana Herring of the Prison Policy Initiative! Andrea Fenster is a Staff Attorney and Tiana Herring is a Research Associate at the Prison Policy Initiative, a nonprofit dedicated to exposing the broader harms of mass criminalization. They will discuss critical issues in criminal legal reform and present data to contextualize mass incarceration in Arizona with the rest of the U.S. and other countries. They will review a variety of topics including prison gerrymandering, prison conditions throughout the COVID-19 pandemic, and pretrial bail reform.
